Form 7004 Extension for a Foreign-Owned Disregarded LLC

A Form 7004 extension can give an eligible business more time to file a specified return.

A Form 7004 extension can give an eligible business more time to file a specified return. For a foreign-owned US disregarded entity filing Form 5472 with a pro forma Form 1120, the IRS provides a particular extension procedure that differs from the ordinary corporate filing route.

An extension should be prepared before the original deadline. It does not automatically extend tax-payment deadlines or fix an already late filing.

Form 7004 extension: confirm the filing being extended

First establish the LLC's tax classification and reporting obligation. This walkthrough concerns the foreign-owned disregarded-entity procedure, not every LLC, partnership or corporation.

The Form 5472 instructions direct these entities to use the Form 1120 code on Form 7004, identify the filing as a foreign-owned US disregarded entity and use the dedicated fax or mailing route. The regular Form 7004 address is not the prescribed route for this case.

Check Why it matters
Entity classification Determines the relevant return and procedure
Tax year Determines the period being extended
Original deadline Extension must be timely
Return code Identifies the return covered
Submission route Special disregarded-entity instructions apply
Payment obligations Filing extension does not postpone payment automatically

Gather the information before the deadline

Retrieve the legal name, EIN, address, tax-year dates and prior filing records. Ask the preparer to confirm the original due date and any applicable relief rather than assuming every business uses the same calendar.

For a typical calendar-year case following the ordinary Form 1120 timetable, April 15 is the usual starting point, subject to weekend, holiday and applicable relief rules. Short years and other circumstances need their own review under the Form 1120 instructions.

Do not wait for completed bookkeeping to begin the deadline assessment.

If the need for a return is uncertain, review the LLC with no income guide before assuming an extension is unnecessary.

Complete and submit the correct request

Use the current Form 7004 and its instructions. Verify the return code, period and identifying information, and add the notation required by the special Form 5472 instructions.

For this foreign-owned disregarded-entity procedure, fax or mail to the dedicated destination identified in those instructions. Do not assume a generic electronic corporate extension submission satisfies the special requirement.

Retain the complete submitted form and transmission or mailing evidence. A preparer's invoice is not proof that the extension was sent.

If identification records are incomplete, recover the EIN confirmation letter and resolve inconsistencies before submission.

Understand what the extension accomplishes

The general Form 7004 instructions describe a generally six-month filing extension and explain that the IRS normally does not send an approval notification. Proper completion and timely submission are essential.

The extension covers the identified return. It does not automatically extend the owner's personal return, state reports, other information filings or payments.

Record each obligation separately. A calendar entry reading only “tax extension done” is too vague for a business with several filing responsibilities.

Use the extra time to finish the records

Reconcile accounts, identify owner contributions and withdrawals, collect related-party details and resolve missing invoices. Give the preparer a documented transaction record rather than just the year-end bank balance.

Our Form 5472 guide explains the underlying reporting topic. The extension is a timing tool, not a substitute for that work.

If the original deadline has already passed, seek advice on the actual late-filing position. Do not backdate documents or assume a late extension removes penalties.

The monthly-close checklist in bookkeeping for foreign-owned LLCs provides a practical way to organize the records still missing.

Agree on the final handoff

Confirm who prepares the final return, what records remain missing and when the completed package will be ready. Keep the extension evidence with the final filing record.

The Form 5472 instructions prescribe a dedicated fax or mailing route for the foreign-owned disregarded-entity extension.
Which return is identified on the extension?
For this procedure, the instructions direct the filer to use the Form 1120 code because Form 5472 accompanies a pro forma Form 1120.
