Older checklists can be misleading if they say every LLC must pay the same minimum privilege tax. Current exemption rules need to be considered separately from income, sales and employer taxes.
Alabama state income tax filing: choose the correct route
| Classification | Return area to examine |
|---|---|
| Disregarded single-member LLC | Owner's applicable income-tax reporting |
| Partnership | Form 65 and relevant owner or composite requirements |
| S corporation | Form 20S and shareholder reporting |
| C corporation | Form 20C and corporate tax requirements |
Use the LLC tax classification guide to confirm the federal starting point. Keep accepted elections and ownership changes with the preparer's records. An LLC filing receipt is not evidence that an S election has been made.
Check the business privilege tax exemption accurately
For tax years beginning after December 31, 2023, Alabama exempts taxpayers whose calculated business privilege tax is $100 or less from filing and paying that tax. Apply the current calculation to determine whether the exemption fits; do not assume it covers every small LLC. Alabama's official change notice.
The exemption concerns business privilege tax. It does not automatically remove an income-tax return, payroll withholding or sales-tax obligation. Keep a written calculation or preparer explanation supporting the conclusion for the particular year.
Provide owner and location details
Prepare an ownership schedule with names, residency, ownership dates and member entity types. Nonresident owners can create additional state payment or reporting questions. A mailing address used by a formation service should not be treated as proof of tax residency.
List Alabama and out-of-state revenue, property and payroll. The preparer needs the facts to evaluate nexus and apportionment rather than assuming all receipts belong to Alabama because the LLC was formed there.
Reconcile the filing package
Gather the federal return or draft, bookkeeping reports, prior Alabama returns, account notices and estimated-payment confirmations. Separate member contributions and loans from customer income; see the owner funding guide.
Use the forms for the correct tax year. Check payment deadlines separately from extensions, and retain the final acceptance acknowledgment. If a software transmission is rejected, preserve the rejection and correction evidence rather than treating the first submission as completed filing.
Coordinate formation and tax setup
The Alabama LLC registration guide covers a new domestic company, while the foreign registration guide covers an existing company formed elsewhere. Neither state filing automatically completes all Department of Revenue registrations.
Build a calendar listing income-tax returns, privilege-tax review and activity-specific accounts separately. This makes the current exemption useful without turning it into an inaccurate claim that an Alabama LLC has no continuing tax responsibilities.
For activity across the Florida border, review the Florida LLC tax filing guide separately. Florida’s lack of an individual income tax does not settle an Alabama owner’s or company’s obligations.
