ITIN vs EIN: What International LLC Owners Need

ITIN vs EIN is a distinction between a tax number for an individual and a tax number for a business or other entity. They are not interchangeable, and obtaining one does not automatically create a requirement for the other.

An international founder should identify the purpose of the requested number before applying. “You own a US LLC” is not, by itself, a complete explanation of why you need an ITIN.

Can the LLC obtain an EIN before the owner has an ITIN?

An eligible foreign responsible party may obtain an EIN without first securing an SSN or ITIN by using the appropriate IRS procedure. That is different from qualifying for the online application.

Once assigned, the EIN identifies the company for relevant purposes. It does not turn the owner's personal tax identity into a business identity.

When an ITIN might be relevant

An individual may need an ITIN for a federal tax return or another qualifying tax purpose when not eligible for an SSN. The application normally involves Form W-7, identity and foreign-status documentation, and an attached tax return unless a documented exception applies.

The W-7 instructions explain the exceptions and acceptable evidence. A generic desire to build credit, open any bank account or obtain immigration benefits is not a substitute for the required tax purpose.

Ask the adviser to identify the specific return or exception before you pay for application support.

Separate bank policy from IRS eligibility

A financial provider may ask for a particular personal identifier as part of its onboarding policy. That request does not automatically make an ITIN application eligible under IRS rules.

Ask whether the provider accepts a passport or foreign tax number in your circumstances. If it requires an ITIN, verify that you independently have a valid federal tax purpose for obtaining one.

Likewise, having an ITIN does not guarantee account approval. The provider still assesses identity, residence, activity and other eligibility conditions.

Keep each number attached to the correct person

Maintain a simple identity record showing the LLC's legal name and EIN, and separately the owner's legal name and applicable personal tax identifier. Use the instructions for the specific form to determine which belongs in each field.

For example, a form requesting the beneficial owner's tax information may not be asking for the LLC's EIN. A business formed in the US can still have a foreign owner whose documentation requires separate treatment.

Do not publish identification documents or full tax numbers in a public company profile.

What an ITIN does not establish

An ITIN does not authorize employment, provide immigration status or determine every question of US tax residence. It is a tax-processing identifier. Tax residence and filing obligations depend on their own rules and facts.

Before commissioning either application, write down who needs the number, why it is required and the evidence supporting the application route.
