US LLC Taxes for Indian Residents: A Two-Country Guide
US LLC taxes for Indian residents cannot be worked out from the formation state alone. You need to identify who earns the income, how each country classifies the LLC, where the work happens and which tax period applies. A US company, American customers and a dollar bank account do not automatically produce tax-free income.

US LLC taxes for Indian residents cannot be worked out from the formation state alone. You need to identify who earns the income, how each country classifies the LLC, where the work happens and which tax period applies. A US company, American customers and a dollar bank account do not automatically produce tax-free income.
This guide is a preparation checklist for a cross-border tax review, based on sources checked on 5 November 2026. It is not a calculation of an individual owner's liability.
US LLC taxes for Indian residents start with four facts
Before asking for a tax quote, prepare the ownership structure, the owner's residence history, a description of the actual business activity and a list of money movements between the owner and LLC.
Two founders can have the same Wyoming formation certificate and very different filing obligations. One may own the business alone; another may have a partner. One may perform all services in India; another may employ people or hold inventory in the US. Those facts deserve more attention than the state name on the certificate.
Identify the US classification
The default federal treatment of a one-owner LLC differs from that of a multi-owner LLC, and an election can change the result. Review your actual classification before selecting returns. IRS LLC classification.
“Disregarded” is a federal tax classification, not permission to disregard the business records. It also does not instruct India to use the same classification. For the detailed US distinctions, see LLC tax classification and foreign-owned LLC tax filing.
Separate income tax from information reporting
When a foreign-owned US disregarded entity has reportable transactions, Form 5472 and the associated pro forma Form 1120 can apply. Contributions and other owner dealings matter even when sales are small or absent. The IRS instructions set out the relevant reporting and penalties. Form 5472 instructions.
Build an owner-transaction ledger from day one. Record contributions, loans, reimbursements and distributions separately, with dates and evidence. Do not give the preparer only the year-end bank balance and assume that describes the year's transactions.
If a filing problem has already arisen, read why a $25,000 Form 5472 penalty can follow a tax filing. A return being submitted does not prove that every required form was included or accepted.
Determine the Indian tax residence and applicable period
Indian tax residence is not the same as citizenship or the address shown on your passport. Ask the accountant to determine the applicable status and scope of reporting for the relevant period, including any distinction between resident and ordinarily resident, resident but not ordinarily resident, and nonresident status.
India's Income-tax Act transition also makes dates important. The official guidance distinguishes the new framework for tax years beginning from 1 April 2026 from earlier periods. Do not copy old section numbers or return instructions into a 2027 filing plan without checking them. Income Tax Department transition guidance.
Ask how India treats the LLC and its earnings
Give your Indian adviser the operating agreement and US tax classification, not just the EIN. Ask how the ownership interest, business profits and distributions are treated in India, and whether management from India affects the analysis.
There are separate questions about the person who earns income, when it is recognised and what happens when cash is distributed. “I left the money in America” is not a reliable answer to all three.
If the same economic income is taxed in both countries, ask how foreign tax credit relief works for that taxpayer and period. Differences in classification, timing or the person paying the tax can prevent a simple dollar-for-dollar comparison. A treaty should be analysed for the actual income and person claiming relief.
Review foreign assets and income reporting
The Income Tax Department publishes guidance on foreign assets and foreign-source income reporting. Its instructions distinguish the applicable residence categories and reporting periods. Use the return and schedules relevant to the actual tax year; do not assume that an earlier form is the final 2027 form. Official foreign-asset reporting guide.
Prepare the LLC ownership record, foreign account statements, peak or closing values where requested, income details and any foreign tax payment evidence. Whether an account produced interest is not the only question relevant to asset reporting.
Ask who will maintain exchange-rate calculations and reconcile the reporting period with the US records. A calendar-year US ledger and an Indian tax-year file should be connected by a reconciliation, not forced into the same dates.
Keep business, GST and investment compliance separate
A US customer or invoice does not by itself settle the GST treatment of services performed in India. Ask the adviser to review the actual supplier, customer, place of supply, contracts and payment route. Do not write “export” on every invoice merely because the LLC is American.
Likewise, income-tax reporting does not replace overseas-investment compliance. The FEMA and funding checklist deals with the investment route and bank reporting; this article addresses tax preparation.
Example: profit, owner payment and distribution
Consider a founder working in Hyderabad who owns a US LLC. During the year, the founder pays a software bill personally, the LLC receives customer revenue, and money is later transferred back to the founder.
The bookkeeping file should identify the business expense, any reimbursement, the revenue and the nature of the later transfer. Those labels must follow the facts. Calling every transfer “salary” or “owner draw” without reviewing the structure can make both countries' reporting harder.
Before closing the year, ask the US and Indian preparers to agree on the documents they need and the treatment of the main transactions. A shared factual summary often prevents more confusion than a last-minute search for the lowest filing quote.
